CUSTOMARY LAWS: STUDY OF KINNAUR

Abstract

The present study deals with the Kinnaura tribe living in the district Kinnaur, Himachal Pradesh. In this study an attempt has been made to identify the customs and customary law of the Kinnaura tribe of Himachal Pradesh (India). This study will be a step to add to the existing literature of the tribal people of Kinnaur in relation to the legal position of their customs and customary laws relating to inheritance, marriage, adoption and other customs. The present study is primarily based on the Wajib-ul-arz (village-wise statement of customs), Riwaz-e-am (district-wise statement of customs) and comprehensive documents of the Government department, commissions, policy planner makers, judicial decisions given by High Court and other law making bodies to promote the customs and customary laws that exist among the Kinnaura tribe of Himachal Pradesh. The present study is more contemporary and exploratory in nature. The main customary laws prevailing among Kinnaura tribe in the specific region of Himachal Pradesh have been focused.
