As per the definition of Health (laid down by WHO), it not only means a state of physical wellbeing but psychological aspects are equally significant in defining health. Even after so much advancement in our society, person suffering with mental illness are considered to be a stigma. To rectify this, India revised its mental health legislation with the introduction of Mental Health Care Act,2017 (here and after referred to as MHCA,2017). The Act came into existence on 7th July 2018 superseding the previous Mental Health Act,1987 bringing a ray of hope for Persons with Mental Illness (herein after referred as PMI). Although providing adequate health care in India is a challenge due to vast population and economic limitations but this Act is a great initiative to protect the Human Rights of PMI and enhance their accessibility to healthcare, treatment, rehabilitation without any kind of discrimination. The Act has brought in a paradigm shift in Human rights approach towards mentally unsound persons in Indian society. They are no more a stigma or liability but are the individuals to be provided with community care and rehabilitation. The Act highlights the crucial role played by community in their treatment instead of keeping them in isolation in addition to integrating mental health care at every possible level in health sector. The Act has incorporated Western concept of mental health care by introducing nomenclatures such as Advance Directives, Nominated Representatives under the Act. But one major loophole of the Act was that unlike Mental Health Act 1987, its drafting was done without involving Indian Psychiatric Society(IPS) who were the main stakeholders. Although quite challenging to implement in society like India where property happens to be a common matter of dispute in families, the Act can prove to be a boon if implemented effectively and efficiently. The main objective of the article is to give a brief overview of the important provisions of MHCA and their possible implications.
