Children are the national assets of every nation and if we see present scenario of the crimes committing against the innocent spirits would be quite shaking for the nation worldwide. Child sexual abuse is a taboo in our society and the surroundings in the society are the common site of the abuse. Whereas, the 2018 ordinance introduces the death penalty for the rape of girls below the age of 12 and provides enhanced prison terms for the rape of girls between the ages of 12 to 16. These amendments are in addition to the existing punishments for sexual offences in the IPC including the death penalty for rape that results in death or a permanent vegetative state and also for the repeat offence of rape. This paper deals with the punishment awarded to the rapist in India whether it should be enhanced or not.
