Abstract

Children indulging in deviant acts is a mounting concern of our society. In India, the age of criminal responsibility is seven years and the age of criminal majority is 18 years. There is a significant relationship between psychology and criminal behavior. This study aimed to discern the need of conducting preliminary assessment for Children in Conflict with Law between the ages of 16 to 18 as per The Juvenile Justice (Care and Protection of Children) Act, 2015, Sec. 15 (1); to ascertain its significance in assessing the mental capacity of such child to commit and understand the consequences of the alleged offence; and its contribution towards efficacy of the trials and directing the judicial opinion in a just manner.
